These Terms of Service ("Terms") govern your access to and use of the website, services, features, and content operated by GlassyIndex LLC ("GlassyIndex," "we," "us," or "our") at glassyindex.com and related domains (the "Site" or "Platform"). By creating an account, clicking "I agree," or otherwise using the Site, you agree to these Terms, our Privacy Policy, Community Guidelines, DMCA & Copyright Policy, and any additional posted rules. If you do not agree, do not use the Site.
1. About GlassyIndex
GlassyIndex is a pricing transparency platform for cosmetic and aesthetic procedures. Patients may submit price reports, reviews, and related information about procedures they received. Clinics may claim profiles and respond to reviews. We do not provide medical advice or endorse providers. Decisions to undergo procedures are solely your responsibility. The Site is intended for use by consumers in the United States. We make no representations that the Site or Services are appropriate or available for use in other locations.
2. Eligibility
You must be at least 18 years old to use the Site. By creating an account you represent and warrant that you are 18 or older and that all information you provide is accurate.
3. Registration and Clickwrap
You must accept these Terms via affirmative clickwrap (e.g., by checking an "I agree" box) during signup. Maintain the confidentiality of your account credentials and notify us immediately of unauthorized use.
4. Account Types and Roles
We offer Patient accounts and Clinic Owner accounts. Each account is permanently assigned one role at registration and may not be converted or combined. Clinic Owners must register through the Clinic flow and use a different email than any Patient account.
4.1 Follow‑Up Review Prompts
GlassyIndex may send automated follow‑up prompts at intervals after a procedure (e.g., approximately 2 weeks, 3 months, and 6 months) to collect updated information about results and satisfaction. These follow‑ups are linked to your original Price Report. Participation is voluntary; you can opt out of follow‑up prompts in account settings or by following instructions in the emails.
5. Sparkle Credibility System
GlassyIndex operates a credibility system called Sparkle to recognize patients who contribute high‑quality, detailed pricing and outcome data. Sparkle points are earned through genuine contributions such as submitting Price Reports, uploading authentic receipts, and providing detailed follow‑up information. Sparkle is a status indicator only: Sparkle points have no monetary value, are non‑transferable, and do not entitle holders to compensation or special placement on the Site. Attempts to manipulate Sparkle (including submitting false or duplicate reports, creating multiple accounts, or coordinating votes) are prohibited and may result in removal of Sparkle points, account warnings, suspension, or termination.
6. Price Reports, Reviews, and Submitted Content
6.1 Representations
By submitting a Price Report or review, you represent that:
- You personally received the procedure described;
- The information (including price, provider, and uploaded receipts) is accurate to the best of your knowledge;
- Receipt images are authentic and unaltered;
- You have not been compensated to post the review unless you disclosed it.
6.2 License to GlassyIndex
By submitting content, you grant GlassyIndex a non‑exclusive, royalty‑free, worldwide, perpetual, irrevocable license to reproduce, distribute, display, modify, and create derivative works of the content in connection with operating the Site, providing the Services, and creating aggregated and anonymized data products, including for commercial purposes. You retain ownership of your content subject to this license.
6.3 Price Reports Cannot Be Deleted; Hiding and Edits
Price Reports cannot be deleted to preserve data integrity. You may request that a Price Report be hidden from public view; hidden reports are retained in our database for internal use. You may edit only limited fields (notes, worth‑it rating, results rating); core pricing fields (price paid, procedure, clinic) cannot be changed after submission. Previous versions are preserved for audit and integrity. To request hiding or permitted edits, contact us via our contact page.
6.4 Receipts
Receipt images and uploaded verification documents are automatically deleted 30 days after upload by our scheduled job, except when deletion is suspended for a pending fraud investigation. After deletion we retain only metadata (uploader ID, upload timestamp, and file hash) for integrity and deduplication.
6.5 Follow‑Up Reviews
Follow‑up responses remain linked to the original Price Report and are retained according to our retention policy.
7. Moderation and Section 230
We moderate content in good faith in accordance with our Community Guidelines. We do not verify every submission for factual accuracy. We may remove, hide, or flag content that violates our policies or that we reasonably believe to be fraudulent, unlawful, or objectionable. Our moderation decisions are made in good faith and are protected to the full extent of applicable law, including Section 230 of the Communications Decency Act. We will not be treated as the publisher or speaker of third‑party user content merely by hosting or moderating it in accordance with our policies.
8. Data Visibility Tiers
GlassyIndex implements tiered data visibility on the Site:
- Public Visitor View: Basic information such as clinic names, locations, and summary price ranges and counts is visible to all visitors.
- Registered Patient View: Additional detail (e.g., unit counts, treatment areas, provider names where provided, and more granular pricing fields) is accessible only to registered, signed‑in patients.
- Internal‑Only Fields: Certain fields are collected for internal analytics and product improvement and are never displayed publicly (e.g., how you discovered a clinic, age range, incentive status). We reserve the right to modify visibility tiers; the Privacy Policy contains details on what is displayed publicly and what is internal‑only.
9. Provider Portability; NPI
GlassyIndex maintains portable provider profiles linked to National Provider Identifier (NPI) numbers where available. Reviews and Price Reports are associated with individual provider profiles and follow providers across clinic affiliations. If a provider moves from one clinic to another, reviews and pricing data tied to that provider remain linked to the provider profile. Clinics acknowledge and agree to provider portability as a condition of using the Platform.
10. Clinic Listings, Claims, and Clinic‑Submitted Pricing
10.1 Clinic Listings from Public Sources
GlassyIndex may create and maintain listings for clinics using publicly available information, including business names, addresses, phone numbers, and provider information sourced from public registries such as the NPI Registry. Clinics may be listed on the Site without prior consent.
10.2 Claiming a Clinic
Only individuals with a legitimate ownership, management, or authorized representative relationship to a clinic may submit a claim to manage a clinic profile. Claims are subject to administrative review and verification, which may take 5–7 business days. We may require identity and authority verification and document submission. Fraudulent claims are grounds for immediate termination of the claimant's account.
10.3 Clinic‑Submitted Pricing and Price History Preservation
Clinics that claim their listings may submit and manage their own pricing through the clinic dashboard. Clinics represent and warrant that submitted prices are accurate and current. When prices change, prior prices are archived (not deleted) for transparency and historical analysis.
10.4 Subscription Neutrality
Certain features require a paid Clinic subscription. Subscription terms, pricing, and features are described at purchase. Subscriptions auto‑renew unless cancelled. Subscriptions do not influence reviews, ratings, or search rankings; paid status does not affect how a clinic appears in search results or how patient content is displayed.
10.5 Clinic Review Integrity Rules
Clinics, providers, and their agents may not:
- Pay, incentivize, or coerce patients to submit, alter, or remove reviews;
- Submit fake patient reviews about their own clinic or competitors;
- Coordinate efforts to flag, downvote, or suppress legitimate patient reviews;
- Retaliate against patients who submit reviews (including threats of legal action or other forms of intimidation);
- Attempt to identify anonymous reviewers or post their private information.
Violation of these rules will result in account suspension, removal of claimed status, and other enforcement actions.
10.6 Clinic Disputes and Flagging
Clinics may flag content they believe violates our Terms or is fraudulent. GlassyIndex will review flags in accordance with the Community Guidelines and DMCA & Copyright Policy. If a clinic disagrees with a Price Report it may submit a public response once the clinic response feature is available (see 10.7). Clinics may not delete or remove patient‑submitted Price Reports or reviews.
10.7 Clinic Response Feature
We may, at our discretion, provide a feature allowing clinics to submit public responses to Price Reports and reviews. When available, such responses will be displayed alongside the original submission.
11. Aggregated and Anonymized Data Licensing; User Commercial Opt‑Out
11.1 Commercial Uses
We create aggregated and de‑identified datasets and analytics derived from user submissions (including pricing, worth‑it and results ratings, reported side effects, duration of results, and deal/discount data) for internal use and for sale or licensing to third parties (including pharmaceutical manufacturers, research organizations, clinic groups, and investors).
11.2 De‑identification and Minimum Cell Size
Prior to sale or licensing we apply de‑identification measures including removal of direct identifiers and suppression of small cells. We enforce a minimum cell size threshold of 5 for aggregated slices and apply combination‑based suppression to reduce re‑identification risk. We may also apply technical privacy controls (e.g., k‑anonymity or noise injection) as appropriate.
11.3 Opt‑Out
You may opt out of having your individual submissions included in third‑party commercial aggregated datasets via an account‑level setting. Opt‑out excludes your submissions from third‑party commercial datasets only; opt‑out does not remove your contributions from public site aggregates, internal product analytics, or anonymized reports used solely for Site operation.
11.4 Buyer Obligations
Data buyers must contractually agree not to attempt re‑identification of contributors and to maintain appropriate security controls.
12. Privacy and Data Handling; HIPAA and State Health Laws
12.1 Privacy Policy
Your use of the Site is governed by our Privacy Policy, which explains what we collect, how we use it, retention schedules, and how to exercise privacy rights (including CCPA/CPRA and other state law notices).
12.2 HIPAA and Consumer Health Data
GlassyIndex is a consumer platform and is not a covered entity or business associate under HIPAA. Information shared voluntarily by patients on the Site is not protected health information under HIPAA by virtue of our operations. However, certain state consumer health data laws (e.g., Washington's My Health My Data Act) may apply to "consumer health data" collected through the Site. Our Privacy Policy contains specific disclosures and mechanisms (including opt‑out and notice) as required by applicable state laws.
13. Cookies and Tracking
We use cookies and similar technologies to operate and improve the Site. We use PostHog (self‑hosted), Vercel Analytics, and Google Search Console for operational analytics. We do not use third‑party advertising cookies or the Meta Pixel. See the Privacy Policy and our Cookie Policy for details.
14. Intellectual Property; Database and Compilation Rights
14.1 Our IP
The Site design, text, graphics, logos, compilations, and selection/arrangement of content are the proprietary works of GlassyIndex and are protected by copyright and other intellectual property laws.
14.2 Anti‑Scraping and Liquidated Damages
Scraping, automated data collection, or bulk copying of Site content without authorization is strictly prohibited. If you access the Site in violation of these Terms (including bypassing access controls, using bots to harvest pricing data, or bulk scraping): you agree GlassyIndex will suffer damages that are difficult to quantify, and you agree to pay liquidated damages of $100 per page or item scraped, with a minimum recovery of $10,000 per incident, plus injunctive relief and attorneys' fees. This liquidated damages provision is intended to be a reasonable pre‑estimate of damages and not a penalty.
14.3 Technical Protections
We use technical protections (rate‑limiting, authentication gates, IP blocks, and other controls) to prevent unauthorized scraping and may pursue legal and technical remedies against violators.
15. DMCA & Copyright Claims
We comply with the Digital Millennium Copyright Act (DMCA). To submit a copyright infringement notice, use the procedure in our DMCA & Copyright Policy. For takedown requests targeting reviews, price reports, or receipts we require a signed declaration, proof of ownership, and a two‑step human review before removing content. Abuse of the DMCA to censor lawful user reviews may expose the submitter to liability under 17 U.S.C. § 512(f). Our DMCA Agent is GlassyIndex Legal Team via the contact page.
16. Indemnification
You agree to indemnify, defend, and hold harmless GlassyIndex, its officers, members, affiliates, and agents from any claims, liabilities, damages, losses, and expenses (including attorneys' fees) arising from (a) your use of the Site, (b) your submitted content, (c) your violation of these Terms, or (d) your violation of any third‑party rights.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GLASSYINDEX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING OUT OF YOUR USE OF THE SITE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID GLASSYINDEX IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
18. Termination; Deactivation
We may suspend or terminate your access at any time, with or without cause. You may request account deactivation via our contact page. Price Reports and reviews you submitted will remain on the Site unless you request they be hidden pursuant to Section 6.3. Surviving provisions include Sections covering license, intellectual property, disclaimers, limitation of liability, indemnification, DMCA, and dispute resolution.
19. Dispute Resolution; Arbitration; Small Claims; Opt‑Out
19.1 Informal Resolution
Before filing a formal claim, you agree to first contact us at our contact page and attempt to resolve the dispute informally for at least 60 days.
19.2 Binding Arbitration
If we cannot resolve a dispute informally, any dispute arising from these Terms or your use of the Site will be resolved by binding arbitration in accordance with the Consumer Arbitration Rules of the American Arbitration Association (AAA), to be conducted in the State of New York. For claims under $10,000, arbitration may be conducted by telephone or written submissions.
19.3 AAA Fees
For consumer claims under $10,000, GlassyIndex will pay the AAA filing and administrative fees.
19.4 Class Action Waiver
YOU AND GLASSYINDEX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
19.5 Opt‑Out
You may opt out of the arbitration and class action waiver provisions by sending written notice through our contact page within 30 days of first using the Services. Include your name, email address, and a clear statement that you wish to opt out.
19.6 Small Claims
Either party may bring an individual action in small claims court as an alternative to arbitration, provided the claim qualifies.
20. Governing Law and Venue
These Terms are governed by the laws of the State of New York without regard to conflict of law principles. To the extent arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts located in New York.
21. California and Other State Privacy Notices
Your rights under state privacy laws are described in our Privacy Policy. To exercise rights under California law (CCPA/CPRA), or other state laws with similar rights, contact us via our contact page.
22. Changes to Terms
We may update these Terms at any time. If we make material changes, we will update the Last Updated date and notify registered users. Continued use after changes constitutes acceptance.
23. Miscellaneous
23.1 Severability. If any provision is found invalid, the remainder shall continue in full force and effect.
23.2 Waiver. Failure to enforce any provision is not a waiver of rights.
23.3 Assignment. You may not assign these Terms. GlassyIndex may assign these Terms without restriction.
23.4 Force Majeure. We are not liable for failure to perform due to circumstances beyond our reasonable control.
