DMCA & Copyright Policy

GlassyIndex LLC ("GlassyIndex," "we," "us," or "our") respects the intellectual property rights of others and expects users to do the same. This DMCA & Copyright Policy describes how we handle claims of copyright infringement on the Site and our processes for notices, counter‑notices, and handling potentially abusive takedown requests.
If you believe content on the Site infringes your copyright, please read this Policy carefully and follow the procedures below.
Our DMCA Agent
To submit a copyright infringement notice, use our contact page. Our designated agent for DMCA notices is: GlassyIndex Legal Team (via the contact page). Do not send DMCA notices to any other addresses.
1. What You Should Know Before Filing a DMCA Notice
- GlassyIndex hosts user‑generated content (e.g., Price Reports, reviews, receipt images). Many such submissions are factual and not subject to copyright protection (facts and raw price information are not copyrightable). Receipt images may contain creative elements (logos, designs) but removal of content that is primarily factual or where the uploader has granted GlassyIndex a license is not appropriate without review.
- Misrepresenting a copyright claim may expose the claimant to liability under 17 U.S.C. § 512(f).
2. How to Submit a Copyright Infringement Notice (Takedown Notice)
To help us process your claim quickly, include the following information in your notice (per DMCA requirements):
- Your full legal name and contact information. (You may use the contact form on our site.)
- A description of the copyrighted work(s) you claim have been infringed.
- A precise description of the content you assert is infringing and its location on the Site (provide URLs or screenshots).
- A statement that you have a good‑faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
- An electronic or physical signature of the copyright owner or agent.
Send your notice via our contact page and select the DMCA option. We will respond to valid notices in accordance with the DMCA.
3. Additional Requirements for Notices Targeting Reviews, Price Reports, or Receipt Images
Because the Site hosts user reviews and factual pricing reports that serve the public interest, we apply heightened scrutiny to takedown notices that would remove reviews or receipt images that substantiate Price Reports. For such notices we require:
- A signed declaration and proof of ownership of the copyrighted material (e.g., registration certificate or clear documentation showing the claimant owns exclusive rights in the image or creative work).
- Identification of the specific material to be removed and an explanation of why the claimant believes the material is infringing (e.g., the receipt image contains a copyrighted photograph owned by the claimant).
- If the allegedly infringing material is a receipt image uploaded by a user, the notice must address whether the uploader granted GlassyIndex a license to display the image (uploader submissions grant GlassyIndex the license in the Terms). Absent compelling evidence of exclusive ownership and lack of uploader authorization, we will generally favor preserving content that substantiates Price Reports.
4. Our Review Process (Two‑Step Human Review for Sensitive Takedowns)
We will process DMCA notices as required by law. For takedown notices affecting reviews, Price Reports, or receipts:
- Step 1 – Preliminary Review: Our DMCA team will verify that the notice includes the required statutory elements and submitted proof of ownership. If the notice is deficient, we will notify the claimant and may refuse to act until sufficient documentation is provided.
- Step 2 – Substantive Human Review: If the notice is complete, we will undertake a substantive human review to assess whether the content is likely infringing and whether removal would improperly censor legitimate user content. This review will consider:
- The factual nature of the content (price reports/reviews) and public interest in preserving such material;
- Whether the uploader granted GlassyIndex a license to display the material under our Terms;
- Whether the claimant's ownership claim is supported by registration or other documentation.
Only after completing both steps and concluding the claim is valid under the DMCA will we remove content.
5. Counter‑Notices
If we remove material in response to a valid DMCA notice, we will notify the uploader and provide the claimant's contact info as required by law. The uploader may submit a counter‑notice that includes:
- A statement under penalty of perjury that the material was removed as a result of mistake or misidentification.
- The uploader's contact information and a statement consenting to jurisdiction in the relevant federal district court or a statement that the uploader will accept service of process from the claimant.
- A physical or electronic signature.
If we receive a proper counter‑notice, we will forward it to the claimant and will restore the removed material within 10–14 business days unless the claimant files a court action seeking to restrain the uploader.
6. Abusive or Bad‑Faith DMCA Notices
We will not tolerate abusive DMCA notices submitted to censor legitimate user content. We will:
- Refuse to act on notices lacking required statutory elements or proof of ownership.
- Preserve the right to recover damages under 17 U.S.C. § 512(f) against any party that knowingly materially misrepresents infringement.
- Notify the uploader if we determine a notice is abusive and provide the uploader a chance to submit a counter‑notice.
7. Receipt Images and Verification Documents
Receipt images uploaded by users are treated as user‑submitted content. Uploaders grant GlassyIndex a license to display such images as described in our Terms. Receipt images will be auto‑deleted after 30 days (except when deletion is suspended for a fraud investigation). For any DMCA claims regarding receipt images, claimants must provide proof of ownership and demonstrate that the uploader lacked authority to grant GlassyIndex the license.
8. Repeat Infringer Policy
We will terminate accounts of repeat infringers in appropriate circumstances. Our repeat infringer policy is enforced in accordance with DMCA safe harbor requirements.
9. Miscellaneous
- This Policy is GlassyIndex's internal procedure and does not create any third‑party rights.
- We may revise this Policy from time to time; the "Last Updated" date will reflect changes.
